SYNOPSIS

     Changes effective date of section 2 of P.L.2007, c.1 concerning the issuance of construction permits for certain child care centers and schools.

An Act concerning contaminated property and amending P.L.2007, c.1.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Section 6 of P.L.2007, c.1 is amended to read as follows:

     6.  This act shall take effect immediately except that section 2 shall take effect on January 11, 2008.

 

     2. This act shall take effect  immediately.

 

 

STATEMENT

 

     This bill would provide that section 2 of P.L.2007, c.1 (C.52:27D-130.5) will take effect 12 months after the date of enactment  of P.L.2007, c.1.  Under that act, the Department of Health and Senior Services (DHSS) was provided 12 months after the effective date of P.L.2007, c.1 to adopt rules and regulations that establish a certification program with procedures and standards for the evaluation of building interiors to be used for child care centers or for education purposes.  However, the law also prohibits the issuance of a construction permit for certain buildings unless the applicant submits a certification from the DHSS and other documentation from the Department of Environmental Protection (DEP) concerning the remediation of the site.  This bill would provide that the requirement to submit a certification from the DHSS and information concerning the remediation of the site from DEP before obtaining a construction permit would take effect on January 11, 2008.
