ASSEMBLY, No. 3203

with Assembly Floor Amendments

(Proposed By Assemblywoman QUIGLEY)

ADOPTED: DECEMBER 15, 2008

These Assembly floor amendments make several changes to Assembly, No. 3203 (1R).

These amendments modify the definition of "eradicate" to provide that eradication of bedbugs in a unit shall not be deemed complete unless there is no bedbug activity for 50 days.

These changes also broaden the provisions allowing a tenant to notify a property owner of the presence of bedbugs by providing that a tenant may notify a landlord based on the presence of characteristic bite marks.  These modifications also expand the required notice to a tenant concerning inspections and the consequences of interfering with a property owner's inspection for bedbugs.

These floor amendments modify the penalty and lien provisions of this bill to make them less punitive and subject to protective judicial process.
