An Act concerning fees for discovery in municipal court cases and supplementing Title 2B of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Fees charged for discovery in matters pending in a municipal court shall not exceed fees specified in section 6 of P.L.2001, c.404 (C.47:1A-5).
2. A person charged an amount greater than the amount specified in section 1 of P.L. c. (C. ) (pending before the Legislature as this bill) may seek the relief specified in section 7 of P.L.2001, c.404 (C.47:1A-6).
3. This act shall take effect immediately.
New Jersey has a strong public policy favoring open access to public records. In the context of a court proceeding, this access should not be restricted by the application of excessively high administrative and clerical fees. Accordingly, this bill imposes a limit on the fees which may be charged with regard to certain materials. The charge for the discovery of written documents in municipal court proceedings shall not exceed the sum of $5.00 for an administrative fee; and the fees specified in P.L.2001, c.404 et seq (C.47:1A-6) as a copying charge.
