An Act concerning spousal support payments and supplementing chapter 34 of Title 2A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Any payment or installment of an order for alimony, or those portions of an order which are allocated for alimony, shall be fully enforceable and shall be a judgment by operation of law on and after the date it is due. Past due alimony payable through the Probation Division shall be automatically docketed as a civil judgment with the Clerk of the Superior Court.
2. This act shall take effect immediately.
This bill provides that past-due alimony payments are a judgment by operation of law on or after the date due. As such, pursuant to court rule, they are subject to post judgment interest at the rates prescribed by Court Rule.
