     Provides workers’ compensation coverage for participants of “Back to Work NJ Program.”

An Act concerning workers’ compensation coverage for workplace training program participants and supplementing Title 34 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    An eligible participant who receives workplace training pursuant to the “Back to Work NJ Program Act,” P.L.   , c.   (C.  ) (pending before the Legislature as Assembly Bill, No. 3584 of 2010), shall not be considered an employee of the eligible employer providing the training for any purpose, except that he shall be treated as if the participant is an employee for purposes of chapter 15 of the Title 34 of the Revised Statutes. The eligible participant shall be provided by the State with all compensation required, and defenses and remedies available pursuant to that chapter, as if the eligible participant was an employee of the State. When determining the amount of any compensation provided pursuant to chapter 15 of Title 34 of the Revised Statutes, the amount of compensation shall be calculated as if the eligible participant’s weekly wage was 60% of the Statewide average weekly wages earned by all employees covered by the “unemployment compensation law,” R.S.43:21-1 et seq.

 

     2.    The amount needed to provide compensation pursuant to section 1 of P.L.   , c.  (C.   ) (pending before the Legislature as this bill) shall be allocated from the sum appropriated from the General Fund to the Department of Labor and Workforce Development pursuant to section 8 of P.L.   , c.  (C.   ) (pending before the Legislature as Assembly Bill, No. 3584 of 2010), but that amount shall not be regarded as a cost associated with the department’s administration of the “Back to Work NJ Program.”

 

     3.    This act shall take effect upon the enactment into law of P.L.   , c.  (C.   ) (pending before the Legislature as Assembly Bill, No. 3584 of 2010).

 

 

STATEMENT

 

     This bill provides workers’ compensation coverage for participants of the “Back to Work NJ Program.” The bill requires that participants of the program be regarded as if they were employees of the State for purposes of workers’ compensation. When determining the amount of any compensation provided pursuant to chapter 15 of Title 34 of the Revised Statutes, the amount of compensation is to be calculated as if the participant’s weekly wage was 60% of the Statewide average weekly wages earned by all employees covered by the “unemployment compensation law,” R.S.43:21-1 et seq.

     Currently, the “Back to Work NJ Program Act,” P.L.   , c.  (C.   ) (pending before the Legislature as Assembly Bill, No. 3584 of 2010), does not provide workers’ compensation coverage to participants of the program. The bill provides that workers’ compensation coverage for participants of the program is to be funded by the appropriation made pursuant to section 8 of the “Back to Work NJ Program Act.”
