SYNOPSIS

†††† Provides certain reemployment rights to teachers dismissed due to a reduction in force.

An Act concerning the reemployment of teachers dismissed due to a reduction in force and supplementing chapter 28 of Title 18A of the New Jersey Statutes.†

 

†††† Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

†††† 1.††† Notwithstanding the provisions of N.J.S.18A:28-12 or any other section of law to the contrary, a teacher whose position is eliminated due to a reduction in force† shall, in the event that the school district reinstates the same position within 18 months of the teacherís dismissal, be given first consideration for that position.

 

†††† 2.††† This act shall take effect immediately.

 

 

STATEMENT

 

†††† Under current law, the determination not to renew the contract of a nontenured teacher is a discretionary matter for the local board of education and, if it results from a reduction in force, there exists no right of reemployment.† Current law also provides that in the event that a teaching staff member (other than a nontenured teaching staff member) is dismissed as a result of a reduction in force, he will be reemployed in order of seniority when a vacancy occurs in a position for which he is qualified.

†††† This bill provides that a teacher whose position is eliminated due to a reduction in force will, in the event that the school district reinstates the same position within 18 months of the teacherís dismissal, be given first consideration for that position.† The bill applies to both tenured and nontenured teachers.†
