Section 2:1c
of the Legislative Code of Ethics prohibits legislators from using or permitting the
use of their official titles in an endorsement or advertisement that promotes a for-profit
enterprise or venture. The Joint Committee determined that the use of a legislator’s
official title in this type of announcement was for identification purposes and not
for the promotion of the bank. It further noted that while becoming a director may be tacit
endorsement of the bank, it is not the type of endorsement contemplated by
section 2:1c of the Code.
As long as the announcement is handled in the same fashion as announcements for all other bank
directors, it would not be deemed an endorsement or advertisement for the bank.
