SYNOPSIS

     Requires holder of casino license to provide certain employees with certain health care and retirement benefits.

An Act requiring the holder of a casino license to provide certain employees with certain benefits and supplementing P.L.1977, c.110 (C.5:12-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The holder of a casino license, as defined in section 10 of P.L.1977, c.110 (C.5:12-10), as a condition of licensure, shall submit proof to the Division of Gaming Enforcement in the Department of Law and Public Safety that all agreements it has entered into with each majority representative of its employees for collective bargaining purposes provide for suitable health care benefits and suitable retirement benefits for all full-time employees covered by such agreements.

     As used in this section, the term:

     “suitable health care benefits and suitable retirement benefits” means benefits that are the greater of a health care plan or a retirement plan: (1) authorized pursuant to a State or federal law; or (2) fully funded by employer contributions and that is commonly provided to full-time employees by the New Jersey gaming industry; and

     “full time employee” means a person who is employed by the licensee for consideration for at least 30 hours per week.

     The provision of this section shall apply to a casino licensee who is licensed on the effective date of P.L.   , c.    (pending before the Legislature as this bill) or becomes so licensed after that effective date.

     A casino licensee who fails to comply with this section shall be subject to forfeiture of that license.

 

     2.    This act shall take effect on the first day of the sixth month next following enactment, except that the Casino Control Commission and the Division of Gaming Enforcement may take any anticipatory administrative action in advance as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill requires the holder of a casino license, as a condition of licensure, to submit proof to the Division of Gaming Enforcement in the Department of Law and Public Safety that all agreements it has entered into with each majority representative of its employees for collective bargaining purposes provide for suitable health care benefits and suitable retirement benefits for all full-time employees covered by such agreements.

     Suitable health care benefits and suitable retirement benefits would be benefits that are the greater of a health care plan or a retirement plan: (1) authorized pursuant to a State or federal law; or (2) fully funded by employer contributions and that is commonly provided to full-time employees by the New Jersey gaming industry.  This bill defines full-time employee to mean a person who is paid for working at least 30 hours per week.

     A casino licensee who fails to comply with the bill’s provisions would be subject to forfeiture of that license.
