SYNOPSIS

     Requires school district to provide transportation to public school students who do not live remote from facility being used temporarily while school building of attendance is renovated.

An Act concerning pupil transportation and supplementing chapter 39 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    If a school building is undergoing reconstruction, remodeling, alteration, modernization, renovation or repair and due to that work the students who attend that school building are temporary required by the school district to attend another facility, the school district shall provide transportation to and from that facility to students who are not eligible for transportation services pursuant to N.J.S.18A:39-1 because they do not live remote from that facility.

     The costs incurred by a school district for the provision of transportation pursuant to this section shall be borne by the State.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill concerns students who have been required by the school district in which they are enrolled to attend a facility on a temporary basis while the school building to which they are regularly assigned is undergoing renovation work.  Under current law, only those elementary school students who live more than two miles from their public school of attendance and secondary school students who live more than two and one half miles from their public school of attendance are considered to live remote from the school of attendance and, therefore, eligible for transportation services.  Under this bill, if a student is required to attend a facility on a temporary basis because his regularly assigned school building is undergoing renovation work, the district would be required to provide transportation to and from the facility even though the student does not live remote from the facility.  The costs incurred by a school district for providing the transportation will be borne by the State.
