     Prohibits sharing of voter information not available to public with any federal government entity, except under certain circumstances.

An Act prohibiting the sharing of State voter information not available to the public with any federal government entities, except under certain circumstances, and supplementing chapter 31 of Title 19 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  No head of a State agency, department, office, authority, unit, or other State instrumentality, and no officer, agency, or department of a county, municipality, authority thereof, or other local unit or political subdivision, shall share with any temporary or permanent commission or other entity of the federal government any of the information pertaining to registered voters contained in the Statewide voter registration system created pursuant to P.L.2005, c.145 (C.19:31-31 et seq.), that is not otherwise available to the public through the provisions of P.L.1963, c.73 (C.47:1A-1 et seq.), including the social security number, digitized signature, or New Jersey driver’s license number or permit number of a registered voter, or the same information held in a similar State government database, or one or more databases maintained by a county, municipality, or other local unit or political subdivision, including an auxiliary voter registration database maintained by a county commissioner of registration.

     b. Subsection a. of this section shall be void in the event that a State agency, department, office, authority, unit, or other State instrumentality, or officer, agency, or department of a county, municipality, authority thereof, or other local unit or political subdivision is directed to provide the voter information that is not otherwise available to the public requested by order of a federal court of competent jurisdiction.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that no head of a State agency, department, office, authority, unit, or other State instrumentality, and no officer, agency, or department of a county, municipality, authority thereof, or other local unit or political subdivision, is permitted to share with any temporary or permanent commission or other entity of the federal government any of the information pertaining to registered voters contained in the Statewide voter registration system that is not otherwise available to the public through the provisions of P.L.1963, c.73, known commonly as the open public records act, including the social security number, digitized signature, or New Jersey driver’s license number or permit number of a registered voter, or the same information held in a similar State government database, or one or more databases maintained by a county, municipality, or other local unit or political subdivision, including an auxiliary voter registration database maintained by a county commissioner of registration.  The provisions of this bill would apply to The Presidential Advisory Commission on Election Integrity, created by Executive Order by President Trump in May of 2017.

     The bill provides that this prohibition would be void in the event that a State agency, department, office, authority, unit, or other State instrumentality, or officer, agency, or department of a county, municipality, authority thereof, or other local unit or political subdivision is directed to provide the voter information that is not otherwise available to the public requested by order of a federal court of competent jurisdiction.
