SYNOPSIS
Requires motorized scooters to be equipped with safety flags when operated on public roadway or bicycle path.

An Act concerning motorized scooters and supplementing Title 39 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. An operator of a motorized scooter shall not operate a motorized scooter on a public roadway or bicycle path unless the motorized scooter is equipped with a conspicuous safety flag in order to make drivers, bicyclists, pedestrians, and other individuals aware of the motorized scooter.
b. An operator of a motorized scooter, who fails to comply with the requirements of this section, and the rules and regulations adopted hereto, shall receive a warning for the first offense, a $10 fine for a second offense, and $20 fine for a third and subsequent offence.
c. The commission shall adopt rules and regulations, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), to implement the provisions of this section. The rules and regulations shall, at a minimum, establish safety flag design specifications and placement requirements.
2. This act shall take effect 180 days after the date of enactment.
STATEMENT
This bill requires motorized scooters to be equipped with conspicuous safety flags when operated on a public roadway or bicycle path in order to make drivers, bicyclists, pedestrians, and other individuals aware of the motorized scooter. The New Jersey Motor Vehicle Commission is to adopt rules establishing safety flag specifications and placement requirements.
