     Requires school bus operations in State to comply with certain federal regulations.

An Act concerning the regulation of school bus operations and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    In addition to the provisions of any State law, rule, or regulation containing more stringent requirements, provided that those requirements are compatible with federal law, and notwithstanding the provisions of any State law, rule, or regulation to the contrary, school bus operations in this State shall comply with the requirements of Part 40 of Title 49 of the Code of Federal Regulations and Chapter III of Title 49 of the Code of Federal Regulations, as amended and supplemented, including, but not limited to: Part 303, Part 325, Part 350, Part 365, Part 366, Part 369, Part 373, Part 374, Part 376, Part 379, Part 380, Part 381, Part 382, Part 385, Part 386, Part 387, Part 389, Part 390, Part 391, Part 392, Part 393, Part 395, Part 396, Part 399, and any other part of Chapter III of Title 49 of the Code of Federal Regulations that the Chief Administrator of the New Jersey Motor Vehicle Commission, in consultation with the Commission of Education, determines is in the public interest to be applicable to school bus operations.

 

     2.    This act shall take effect 180 days following the date of enactment.

 

 

STATEMENT

 

     This bill requires school bus operations in the State to comply with the provisions of Part 40 of Title 49 of the Code of Federal Regulations and various parts of Chapter III of Title 49 of the Code of Federal Regulations concerning civil rights requirements, noise emissions, certain federal programs, registration and insurance, drug testing, safety fitness procedures, and certain safety requirements.  The bill allows the Chief Administrator of the New Jersey Motor Vehicle Commission, in consultation with the Commission of Education, to determine if any other parts of Chapter III of Title 49 of the Code of Federal Regulations ought to be applicable to school bus operations.
