     Requires DEP to provide for annual suppression of black flies along Delaware River.

An Act concerning black fly suppression along the Delaware River and supplementing Title 13 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The Department of Environmental Protection shall provide for the suppression of black flies each year along the Delaware River, using chemical or other effective means. If the department chooses to conduct the suppression in cooperation with another state, the department may negotiate with the other state regarding how the suppression shall be accomplished and the funding to be provided, and may contract with the other state to have that state conduct the spraying, provided that the suppression is conducted each year at least on the New Jersey side of the Delaware River.  The department shall include sufficient funding for the black fly suppression in its annual budget request.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the Department of Environmental Protection to provide annual suppression of black flies each year along the Delaware River, using chemical or other effective means.  The bill allows for the department to conduct the suppression in cooperation with another state, negotiate with the other state regarding how the suppression is to be accomplished and the funding to be provided, or contract with the other state to have that state conduct the suppression, provided that the suppression is conducted each year at least on the New Jersey side of the Delaware River.  The bill directs the department to include sufficient funding for the suppression in its annual budget request.
