     Establishes “5G Network and Development Task Force.”

An Act establishing the “5G Network and Development Task Force.”

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.   There is established, in the Department of Community Affairs, a task force to be known as the “5G Network and Development Task Force.”

     b.    The task force shall consist of five members as follows:

     (1)   the Commissioner of Community Affairs, or a designee;

     (2)   the President of the Board of Public Utilities, or a designee;

     (3)   one member who is a representative of the New Jersey State League of Municipalities, appointed by the Governor;

     (4)   one public member appointed by the Governor upon the recommendation of the President of the Senate; and

     (5)   one public member appointed by the Governor upon the recommendation of the Speaker of the General Assembly.

     c.     The members of the task force shall be appointed within 60 days following the effective date of this section.  The task force shall organize as soon as practicable after the appointment of a majority of its members.  The Commissioner of Community Affairs, or the commissioner’s designee, shall serve as chairperson of the task force.  The presence of three members of the task force shall constitute a quorum.  The task force may conduct business without a quorum, but may only vote on the issuance of the report required to be submitted to the Governor and the Legislature pursuant to subsection g. of this section when a quorum is present.  Vacancies in the membership of the task force shall be filled in the same manner as the original appointments.

     d.    All task force members shall serve without compensation, but shall be eligible for reimbursement of necessary and reasonable expenses incurred in the performance of their official duties within the limits of funds appropriated or otherwise made available to the task force for its purposes.

     e.     The Department of Community Affairs shall provide such stenographic, clerical, and other administrative assistants, and such professional staff, as the commission requires to carry out its work.  The task force shall also be entitled to call to its assistance and avail itself of the services of the employees of any State, county, or municipal department, board, bureau, commission, or agency as it may require and as may be made available to it for its purposes.

     f.     The task force may meet and hold public hearings at the place or places it designates during the sessions or recesses of the Legislature.

     g.    The task force shall study State and federal law and develop recommendations for State statutory changes necessary to ensure that future development in the State accommodates, and does not disrupt, “5th Generation” wireless networks, and shall, within one year of the effective date of this section, prepare and submit a report to the Governor and the Legislature, pursuant to section 2 of P.L.1991, c.164 (C.52:14-19.1), setting forth the results of its studies and its recommendations.

     h.    The task force shall expire upon the submission of its report.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill establishes the “5G Network and Development Task Force” to study and develop recommendations on how to harmonize the approaching rollout of “5th Generation” (5G) wireless networks and future development within the State.  Before 5G networks begin to be rolled out, the requirements for building in the State are going to have to be updated in order to ensure that these networks are not disrupted by future development.  This task force would be charged with laying critical groundwork in anticipation of the shift to 5G network technology.

     The task force would consist of five members as follows:

     (1)   the Commissioner of Community Affairs, or a designee;

     (2)   the President of the Board of Public Utilities, or a designee;

     (3)   one member who is a representative of the New Jersey State League of Municipalities, appointed by the Governor;

     (4)   one public member appointed by the Governor upon the recommendation of the President of the Senate; and

     (5)   one public member appointed by the Governor upon the recommendation of the Speaker of the General Assembly.

     The task force would have one year from the bill’s effective date to submit a report to the Governor and the Legislature setting forth the results of its studies and recommendations.  The task force would expire upon the submission of this report.
