     Requires payment of State employees’ compensation during involuntary furlough or temporary reduction in force due to late enactment of State annual appropriation act.

An Act requiring the payment of State employees’ compensation during an involuntary furlough or other reduction in force occasioned by the late enactment of a State annual appropriation act, supplementing Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding any provision of law, rule, regulation, or order to the contrary, due to a late enactment of a State annual appropriation act in any fiscal year, all Executive branch, Judicial branch, and Legislative branch employees, who were subject to involuntarily furlough or other temporary reduction in workforce, and who were ready, willing, and able to report for work duty, shall promptly receive their full salary or wage payment otherwise due to them despite a shutdown of State programs and functions.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that State employees who are subject to an involuntary disruption of service due to a shutdown of State government due to a State budget impasse are entitled to their full salary or wages.  This bill applies to a period of time that there is a late enactment of a State annual appropriation act in any fiscal year.  All Executive branch, Judicial branch, and Legislative branch employees, who are subject to involuntarily furlough or other similar temporary reduction in workforce due to a late enactment of a State budget, and who were ready, willing, and able to report for work duty during that period, shall promptly receive their full salary or wage payment otherwise due to them.  This bill will clarify that all State employees deemed non-essential, and barred from work during a State budget shutdown, who are unable to work for no other reason, are entitled to promptly receive their full salary or wage payment.
