SYNOPSIS

     Confers title of Acting Associate Justice of the Supreme Court on certain judges of the Superior Court, Appellate Division, temporarily assigned to the Supreme Court.

An Act conferring the title of Acting Associate Justice of the Supreme Court on certain judges and supplementing Title 2B of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    If the Chief Justice, pursuant to Article VI, Section II, paragraph 1 of the Constitution of New Jersey and applicable Rules of Court, assigns a judge of the Superior Court, Appellate Division, to serve temporarily in the Supreme Court, and that judge serves in the Supreme Court for a continuous period of at least 180 days, the official title of that judge, while continuing service in the Supreme Court, as well as for all historical purposes associated with that service, shall be “Acting Associate Justice of the Supreme Court.”  For purposes of this section, a discontinuance of service in the Supreme Court of 30 days or less, due to an absence or inability to act, for whatever reason, shall not render a temporarily assigned judge’s period of service non-continuous.

 

     2.    This act shall take effect immediately and shall be retroactive to January 1, 2010.

 

 

STATEMENT

 

     This bill would confer the title of Acting Associate Justice of the Supreme Court on any judge of the Superior Court, Appellate Division, assigned by the Chief Justice to temporary service in the Supreme Court for a continuous period of at least 180 days.  Under the bill, a discontinuance of service in the Supreme Court of 30 days or less, due to an absence or inability to act, for whatever reason, would not render a temporarily assigned judge’s period of service non-continuous.

     The bill would take effect immediately and apply retroactively to January 1, 2010.
