SYNOPSIS

     Provides medical cannabis dispensaries permitted use status in certain zoning districts.

An Act concerning the location of medical cannabis dispensaries and supplementing P.L.1975, c.291 (C.40:55D-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    A medical cannabis dispensary shall be a permitted use within every commercial or business district of a municipality, and any other zoning district within which a pharmacy, a drugstore, or a retail business is a permitted or conditional use.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would provide that a medical cannabis dispensary is a permitted use in a commercial or business district of a municipality, and in any other zoning district within which a pharmacy, a drugstore, or a retail business is a permitted or conditional use.  A medical cannabis dispensary is an organization that has been issued a permit by the State to, among other things, purchase medical cannabis and sell it to qualifying patients.
