with Senate Floor Amendments

      These floor amendments would eliminate in subsection m. of section 2 the provisions of the bill which would permit the reduction of inmates’ current mandatory terms of imprisonment for second degree robbery, N.J.S.2C:15-1, and second degree burglary, N.J.S.2C:18-2.  These provisions would have changed the terms from 85 percent of the sentence imposed, as required under current law pursuant to section 2 of P.L.1997, c.117 (C.2C:43-7.2), known as the No Early Release Act (NERA), to 50 percent of the sentence imposed.

      The floor amendments also eliminate current subsection b. from section 1 of the bill concerning retroactive modification and resentencing of the conviction of those persons convicted of these same offenses. 

      The floor amendments clarify that retroactive modification shall not apply to a conviction for leader of a narcotics trafficking network.

      These amendments make this bill identical to Senate No. 2593 (3R).
