ASSEMBLY COMMITTEE SUBSTITUTE FOR

ASSEMBLY, No. 5139

      The Assembly Commerce and Economic Development Committee reports favorably an Assembly Committee Substitute for Assembly, No. 5139.

     This committee substitute would allow food and beverage establishments to seat patrons in an open air space with a fixed roof or temporary or seasonal awning or cover with at least two sides through which egress is possible, provided that the roof, temporary or seasonal awning, or cover complies with applicable requirements under law.  

     The substitute would specifically authorize a food or beverage establishment to seat a patron in an open air space with a fixed roof or temporary or seasonal awning or cover without complying with any requirement concerning snow loads, except when the roof, awning, or cover has any presence of snow, unless the roof, awning, or cover is certified to hold a snow load pursuant to the State Uniform Construction Code.
