SYNOPSIS

     Requires provision of certain information on License Verification System concerning health care professionals.

An Act concerning health care professionals and supplementing P.L.2002, c.104 (C.45:1-28 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The director shall provide a full background with links to supporting documents on the web-based License Verification System maintained by the Division of Consumer Affairs for any health care professional whose license may be verified through use of that system.  The background information shall include, but need not be limited to, the following information:

     (1)   any professional discipline by a professional or occupational licensing board within the division that regulates the practice of a health care professional in this State or any other state;

     (2)   any malpractice claim, settlement, or judgment against the professional;

     (3)   any loss of hospital privileges;

     (4)   any criminal convictions;

     (5)   any Medicaid or Medicare exclusions pursuant to 42 U.S.C. s.1320a–7;

     (6)   any actions taken against the professional by federal regulators, including but not limited to, the U.S. Food and Drug Administration and the Drug Enforcement Agency; and

     (7)   any other information as determined by the director pursuant to regulation.

     b.    A professional or occupational licensing board within the division that regulates the practice of a health care professional shall report to the director any information relevant to the web-based background information established pursuant to subsection a. of this section.

     c.     The director shall promulgate rules and regulations in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) to effectuate the purposes of this act.

 

     2.    This act shall take effect on the 90th day next following the date of enactment.

 

 

STATEMENT

 

     This bill requires the Director of the Division of Consumer Affairs to provide certain information concerning health care professionals on the License Verification System maintained by the division for any health care professional whose license may be verified through use of that system.

     The bill provides that the background information must include, but need not be limited to, the following information:

     (1)   any professional discipline by a health care professional board in this State or any other state;

     (2)   any malpractice claim, settlement, or judgment against the professional;

     (3)   any loss of hospital privileges;

     (4)   any criminal convictions;

     (5)   any Medicaid or Medicare exclusions pursuant to 42 U.S.C. s.1320a–7;

     (6)   any actions taken against the professional by federal regulators; and

     (7)   any other information as determined by the director pursuant to regulation.

     The bill also requires the professional licensing boards that regulate the practice of health care professionals to report to the director any information relevant to the web-based background information required to be provided pursuant to the bill.
