STATEMENT TO

SENATE, No. 2798
with Assembly Floor Amendments
(Proposed by Assemblyman CONAWAY)
ADOPTED: JUNE 3, 2021
These floor amendments:
1) change the definition of “long-term care facility”;
2) provide that a facility that is unable to hire an infection preventionist on a full-time or part-time basis may contract with an infection preventionist on a consultative basis until February 1, 2022;
3) provide that a facility is to hire an infection preventionist on a full-time or part-time basis after February 1, 2022, except that the Department of Health may waive this requirement if a facility is unable to hire an infection preventionist following the facility’s good faith efforts to hire an infection preventionist;
4) provide that in the case of a facility located in the same building or on the same property as a nursing home or a facility that is located within a continuing care retirement community, the facility is to be permitted to hire one full-time infection control preventionist who will be responsible for the facility and the nursing home or for the facility and the continuing care retirement community; and
5) add and define the terms “comprehensive personal care home,” “dementia care home,” “facility,” and "residential health care facility.”
