SENATE, No. 2923

with Senate Floor Amendments

(Proposed by Senator TURNER)

ADOPTED: FEBRUARY 19, 2021

      These Senate amendments:

      (1) permit the election board or the superintendent of elections in the county in which an election is held to contact a law enforcement agency if information is obtained prior to the election that in the judgment of the election board or superintendent of elections should be communicated to a law enforcement agency;

      (2) allow an off-duty police officer to serve as a member of a district board of elections;

      (3) require the district board of elections to notify the county board of elections or superintendent of elections, instead of the Secretary of State, when a law enforcement officer is detailed or assigned to the polling place following a summons, and the county board of elections or superintendent of elections to then promptly notify the Secretary of State of that detail or assignment;

      (4) prohibit a law enforcement officer to remain or stand within 100 feet of a ballot drop box during the conduct of an election; and

      (5) provide an exemption to the prohibition against a law enforcement officer from remaining or standing within 100 feet of a polling place or ballot drop box for an officer who is voting in a personal capacity at the polling place or ballot drop box or who is traveling to and from, or remaining within, their personal residence located within 100 feet of a polling place or ballot drop box.

      These amendments also remove a reference to January 1, 2021 concerning the location of a ballot drop box near a law enforcement agency.
