SYNOPSIS

     Requires Secretary of State and county commissioners of registration to perform audit of voter registration records in Statewide Voter Registration System.

An Act concerning an audit of the voter registration records in the Statewide Voter Registration System and supplementing P.L.2005, c.145 (C.19:31-31 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Within 90 days of the effective date of this act, P.L.   , c.  (C.   ) (pending before the Legislature as this bill), the Secretary of State and each county commissioner of registration shall perform an audit of the voter registration records in the Statewide Voter Registration System established pursuant to P.L.2005, c.145 (C.19:31-31 et seq.). The purpose of the audit shall be to identify the following:

     (1)   any voter registration records of persons who are ineligible to vote who successfully registered to vote;

     (2)   whether any person who is ineligible to vote attempted to register to vote, even if that attempt was not successful; and

     (3)   whether the procedures to ensure that a reasonable effort is made to remove registrants who are ineligible to vote pursuant to federal or State law are effective, as required under subsection b. of section 2 of P.L.2005, c.145 (C.19:31-32).

     b.    The Secretary of State and county commissioners of registration shall jointly develop the audit methodology, processes, and procedures, which shall apply uniformly in each county.

     c.     Within 30 days of completing the audit required under this section, the Secretary of State and county commissioners of registration shall issue a report to the Governor, and to the Legislature pursuant to section 2 of P.L.1991, c.164 (C.52:14-19.1), containing the results of the audit, their findings, and recommendations.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the Secretary of State and county commissioners of registration to perform an audit of the voter registration records in the Statewide Voter Registration System within 90 days of its effective date. The purpose of the audit is to identify (1) any voter registration records of persons who are ineligible to vote who successfully registered to vote; (2) whether any person who is ineligible to vote attempted to register to vote, even if that attempt was not successful; and (3) whether the procedures to ensure that a reasonable effort is made to remove registrants who are ineligible to vote pursuant to federal or State law are effective, as required under current law.

     The bill directs the Secretary of State and county commissioners of registration to jointly develop the audit methodology, processes, and procedures to apply uniformly in each county. Within 30 days of completing the audit, the Secretary of State and county commissioners of registration are directed to issue a report to the Governor and to the Legislature containing the results of the audit, their findings, and recommendations.
