An Act establishing a New Jersey State House Flag Program and supplementing P.L. 1992, c.67 (C.52:31-34 et seq.).

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. The State Capitol Joint Management Commission shall establish a New Jersey State House Flag Program which allows a person or group to purchase a New Jersey State flag which has flown over the State House in Trenton. Application to purchase a flag shall be made upon a form prescribed by the commission. Forms shall be available through the office of the Governor and the district offices of members of the Legislature. The elected official providing a form to a purchaser shall indicate thereon that official's sponsorship of the purchase. Upon receipt of a completed form and the appropriate fee, the commission shall forward the flag to the purchaser together with a certificate which documents the flag's authenticity and indicates the name and office of the elected official who sponsored the application.

    The price for the purchase of a flag shall be the cost to the commission of acquiring the flag and reasonable labor, clerical and shipping costs, plus a fee of $10. All monies received from the sale of flags shall be paid into the fund established by section 2 of P.L. , c. (C. ) (now pending before the Legislature as this bill) and used solely for the purposes described therein.

 

    2. There is established in the State Department of the Treasury a special fund to be known as the New Jersey State House Flag Program Fund into which shall be paid all monies received from the sale of flags pursuant to section 1 of P.L. , c. (C. ) (now pending before the Legislature as this bill). Monies in the fund shall be appropriated first to reimburse the State Capitol Joint Management Commission for the cost of acquiring flags sold through the New Jersey State House Flag Program and for reasonable labor, clerical and shipping costs associated with the program. Monies remaining in the fund after the commission is reimbursed for these expenses shall be appropriated to the commission and used by it to defray expenses associated with the restoration, preservation or decoration of the State capitol complex. The State Treasurer may invest or reinvest monies in the fund, but any income derived from monies so invested shall be deposited in the fund. The investment of funds shall be consistent with the policies of the Division of Investment.

 

    3. This act shall take effect immediately.
