An Act concerning notaries public and amending R.S.41:2-3.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. R.S.41:2-3 is amended to read:

    41:2-3. Oaths administered by notaries public in [bank] financial institution matters.

    a. A notary public who is a stockholder, director, officer, employee or agent of a [bank] financial institution or other corporation may administer an oath to any other stockholder, director, officer, employee or agent of the corporation.

    b. A notary public who is an employee of a financial institution or other corporation may refuse to administer an oath to any person during the hours of the notary public's regular employment as an employee of the financial institution or other corporation or while on the premises of the notary public's employer.

    As used in this section, "financial institution" means a State or federally chartered bank, savings bank, savings and loan association or credit union.

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    The bill permits a notary public who is an employee of a financial institution or other corporation to refuse to administer an oath to any person during the hours of the notary public's regular employment as an employee of the bank or other corporation or while on the premises of the notary public's employer.

 

Clarifies obligations of certain notaries public.
