      The Assembly Education Committee reports favorably Assembly Bill No. 281 with committee amendments.

      As amended by committee, this bill requires the Commissioner of Education to render a decision by November 1 on any budget appeal filed with the commissioner by a Type I school district or a Type II school district with a board of school estimate in regard to the decision of the board of school estimate on the amount of money to be appropriated to the school district for the next budget year. The bill also requires the commissioner to render a decision by November 1 whenever a Type II school district appeals the decision of a municipal governing body on a reduction of the district's budget after the defeat of that budget by the voters. The bill provides that the November 1 date may be waived when the delay is caused by action of the parties.

      The committee amended the bill to provide that the November 1 date may be waived when the delay is caused by action of the parties.

      This bill was pre-filed for introduction in the 1996 session pending techinical review. As reported, the bill includes the changes required by technical review, which has been performed.
