An Act concerning the permanent appointment of certain police officers and amending P.L.1962, c.56.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Section 1 of P.L.1962, c.56 (C.40:47-20.10) is amended to read as follows:

    1. Any appointment to the police department of a municipality heretofore made of an individual otherwise qualified who on the date of appointment exceeded the maximum age for appointment by less than [10] 15 months, after the allowance of credit for his military service in time of war, is hereby validated and confirmed and the continued employment of such person as a member of the police department is authorized[, provided said appointment is confirmed by resolution of the governing body adopted within 30 days after the effective date of this act].

    2. Section 2 of P.L.1962, c.56 (C.40:47-20.11) is amended to read as follows:

    2. The board of trustees of the police and firemen's retirement system of New Jersey shall accept as a member of the retirement system any policeman, otherwise eligible for membership, whose appointment is confirmed pursuant to [this act] P.L. , c. (pending before the Legislature as this bill), provided there is paid into the retirement system, in such manner as the board shall prescribe, the contributions that would have been payable had he been so appointed at the maximum age [of 30 years] for appointment under N.J.S.40A:14-127.

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill validates the appointment of certain police officers who were made permanent employees even though their age is above 35 years old. The bill confirmsx the appointments of those officers who were made permanent employees within 15 months of their 35th birthdays. The bill also requires the board of trustees of the police and firemen's retirement system of New Jersey to accept these officers as members of that retirement system, provided there is paid into the retirement system, in such manner as the board shall prescribe, the contributions that would have been payable had the officers been so appointed at the maximum age for appointment permitted by law.
