An Act concerning public assistance and supplementing P.L.1947, c.156 (C.44:8-107 et seq.).

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. A person released from a county correctional facility shall not be eligible for public assistance pursuant to the "General Public Assistance Law," P.L.1947, c.156 (C.44:8-107 et seq.) in the municipality in which the correctional facility is located until 90 days after the person has been released from the correctional facility, except that if the person's last permanent address prior to incarceration was the municipality in which the correctional facility is located, there shall be no waiting period.

    b. The Department of Human Services shall promulgate regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) concerning the determination of last permanent address for the purposes of this section.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill provides that a person who has been released from a county correctional facility will not be eligible for public assistance pursuant to the "General Public Assistance Law," P.L.1947, c.156 (C.44:8-107 et seq.) in the municipality in which the correctional facility is located until 90 days after the person has been released from the correctional facility. However, if the person's last permanent address prior to incarceration was the municipality in which the correctional facility is located, there would not be the 90-day waiting period.


 

Establishes 90-day waiting period for certain persons released from county correctional facility to receive general assistance in the municipality of the facility.
