An Act concerning fencing on overpasses on State roads and supplementing chapter 7 of Title 27 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding any law, rule or regulation to the contrary, whenever any repair, construction or reconstruction is undertaken by the Department of Transportation on any road under its jurisdiction, the department shall install protective fencing along any overpass on that road of such height and strength as to prevent the dropping of objects from that overpass.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill would require the Department of Transportation to install protective fencing along any overpass whenever any repair, construction or reconstruction is undertaken by the department on any road under its jurisdiction.

    The tragic death of an 18 month old child caused by a bowling ball dropped from an overpass illustrates the need for protective fencing along overpasses.
