An Act concerning grants provided under the Youth Transitions to Work Partnership and related federal programs and supplementing P.L.1993, c.268 (C.34:15E-1 et seq.).

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. In the case of any grant awarded by the Youth Transitions to Work Partnership to a consortium pursuant to sections 5, 6 or 7 of P.L.1993, c.268 (C.34:15E-5, 34:15E-6 or 34:15E-7), each participant in the consortium, including a participating employer, business or trade organization, labor organization or institution of higher education or other educational institution, shall be eligible to serve as the fiscal agent for the consortium. Each grant may be awarded to a consortium for a term of longer than one year.

    b. The provisions of subsection a. of this section shall be disclosed in writing in any application form or request for proposals provided to applicants for grants from the partnership.

 

    2. Each subgrant provided to a local partnership by the State pursuant to section 215(b) of the "School-to-Work Opportunities Act of 1994," Pub.L. 103-239 (20 U.S.C. §6145(b)) shall be subject to those provisions of section 1 of this act and sections 1 through 9 of P.L.1993, c.268 (C.34:15E-1 through 34:15E-8 and C.34:15C-8.3) which apply to grants awarded to consortiums by the Youth Transitions to Work Partnership, except that:

    a. If the federal agencies responsible for authorizing funding to the State under the "School-to-Work Opportunities Act of 1994" certify in writing that the application of any particular provision of this act or of sections 1 through 9 of P.L.1993, c.268 (C.34:15E-1 through 34:15E-8 and C.34:15C-8.3) to the subgrant is prohibited by applicable federal law or results in any reduction in the amount of federal funding, that provision shall not be applied to the subgrant; and

    b. In the case of a local partnership which receives a subgrant to establish a school-to-work opportunities program, the school-to-work opportunities program shall be designed to prepare participating secondary students for:

    (1) Entry into a registered apprenticeship program which is newly created under the subgrant in a manner consistent with the provisions of sections 1 through 9 of P.L.1993, c.268 (C.34:15E-1 through 34:15E-8 and C.34:15C-8.3); or

    (2) Admission to a two-year or four-year college or university.

 

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill provides that, in the case of a Youth Transitions to Work Partnership grant awarded to a consortium, each consortium participant, including any participating employer, business or trade organization, labor organization, institution of higher education or other educational institution, is eligible to serve as the fiscal agent for the consortium. The grant may be awarded for a term of longer than one year. The bill requires the disclosure of these provisions to all grant applicants.

    The bill makes each subgrant provided by the State to a local partnership under the federal "School-to-Work Opportunities Act of 1994" subject to each provision of this bill and New Jersey's "Youth Transitions to Work Partnership Act," P.L.1993, c.268 which applies to grants awarded to consortiums by the Youth Transitions to Work Partnership, unless applying the provision to the federal subgrant is prohibited by federal law or would result in reduced federal funding. Also, if the subgrant is to establish a school-to-work opportunities program for an occupation which currently has no registered apprenticeship program, the school-to-work opportunities program shall be designed to prepare participating secondary students for entry into a registered apprenticeship program newly created under the subgrant pursuant to P.L.1993, c.268 or for admission to a two-year or four-year college.
