An Act concerning certain pupils experiencing difficulty in class and supplementing chapter 36 of Title 18A of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Each board of education shall adopt and implement school-based policies and procedures for the delivery of intervention and referral services for pupils who are experiencing difficulties in their classes and who are not receiving special education programs or services pursuant to chapter 46 of Title 18A of the New Jersey Statutes.

 

    2. The Department of Education shall provide training and technical support to school districts to assist them in developing and implementing the policies and procedures required pursuant to section 1 of this act.

 

    3. Regulations adopted by the State Board of Education pursuant to the provisions of this act shall not mandate a particular mechanism or procedure for accomplishing the provisions of section 1 of this act.

 

    4. This act shall take effect immediately and the provisions of section 1 of this act shall first apply to school districts in the 1994-95 school year.

 

 

STATEMENT

 

    This bill requires each board of education to adopt and implement school-based policies and procedures for the delivery of intervention and referral services for pupils who are experiencing difficulties in their classes and who are not receiving special education programs or services. The Department of Education will provide training and technical support to school districts to assist them in developing and implementing the policies and procedures which are required. In addition, the regulations adopted by the State Board of Education pursuant to the provisions of the bill would not mandate a particular mechanism or procedure for the delivery of the intervention and referral services.
