An Act concerning certain sentences of imprisonment for certain repeat offenders and supplementing Title 2C of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding the provisions of N.J.S.2C:43-6, N.J.S.2C:43-7 and N.J.S.2C:44-3 or any other provision of this Title, a person convicted of a crime of the first degree who has been convicted previously of a crime of the first degree on two separate occasions arising out of two separate incidents shall be sentenced to a term of life imprisonment with no eligibility for parole.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill provides that a person convicted for the third time of a crime of the first degree shall be sentenced to a term of life imprisonment with no eligibility for parole. The bill states that a person convicted of a crime of the first degree who has been convicted previously of a crime of the first degree on two separate occasions arising out of two separate incidents shall be sentenced to a term of life imprisonment with no eligibility for parole. Thus, this bill would not provide a mandatory life term for a person convicted of three counts of first degree kidnapping arising out of the same incident. However, a pperson convicted on two previous occasions of kidnapping who is subsequently convicted a third time would receive life imprisonment with no possibility of parole under this bill.
