An Act prohibiting condom distribution in State institutions and supplementing Title 30 of the Revised Statutes and Title 18A of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. It is the public policy of the State that any program involving the distribution of condoms in State institutions would send a false signal to residents, patients and students of those institutions regarding the safety of their use in the prevention of transmission of disease and would encourage improper behavior among residents, patients and students of State institutions.

 

    2. The Department of Corrections shall not distribute a condom to an inmate of a State correctional facility as those facilities are defined pursuant to section 8 of P.L.1976, c.98 (C.30:1B-8).

 

    3. The Department of Human Services shall not distribute a condom to a resident or patient of a State institutional facility as those facilities are defined pursuant to R.S.30:1-7.

 

    4. The Department of Education shall not distribute a condom to a student attending a school or educational facility.

 

    5. The Department of Higher Education shall not distribute a condom to a student attending an institution of higher education.

 

    6. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill prohibits the distribution of condoms in State institutions. The bill prohibits the Department of Corrections from distributing condoms to inmates of State correctional institutions; the Department of Human Services from distributing condoms to residents or patients of State institutional facilities; the Department of Education from distributing condoms to students attending a school or educational facility; and the Department of Higher Education from distributing condoms to students attending an institution of higher education. It is the sponsor's belief that any program involving the distribution of condoms in State institutions would send a false signal to residents, patients and students of those institutions regarding the safety of their use in the prevention of transmission of disease. The sponsor also believes that distribution of condoms would result in untold liability on the part of persons involved in a distribution program.
