An Act concerning the office of register of deeds and mortgages, amending N.J.S.40A:9-80, and repealing N.J.S.40A:9-81 through N.J.S.40A:9-93.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. N.J.S.40A:9-80 is amended to read as follows:

    40A:9-80 The office of register of deeds and mortgages heretofore established and now in existence in any county is [confirmed and shall be continued until altered or abolished as provided by law] abolished, except that any such office of register of deeds and mortgages shall continue, and the individual holding the office on the effective date of P.L. ,c. (pending before the Legislature as this bill) shall continue in office and in the exercise of the powers, functions, and duties of the office, until either the expiration of the current term of office or a vacancy shall occur other than by expiration of term.

    Upon either the expiration of the current term of office or the occurrence of a vacancy other than by expiration of term, the office of register of deeds and mortgages shall be consolidated with the office of county clerk and the powers, functions, and duties of the register of deeds and mortgages shall pertain to the county clerk.

    2. N.J.S.40A:9-81 through N.J.S.40A:9-93 of the New Jersey Statutes are repealed.

 

    3. This act shall take effect immediately.


STATEMENT

 

    This bill eliminates the county office of register of deeds and mortgages, but allows those who currently hold the office to continue in office until the end of their term or until they vacate office, whichever comes first.

    This bill also consolidates the powers, functions, and duties of the office of register of deeds and mortgages with those of the county clerk. Because the State has, by constitutional amendment and law, assumed responsibilities and costs for certain parts of the judicial system recently, the county clerk has been relieved of certain responsibilities and is now in a position to assume those of the register of deeds and mortgages.

    Finally, this bill repeals various sections of the New Jersey Statutes concerning the office of register of deeds and mortgages.
