An Act creating a "Lead Toxicity Detection and Prevention Fund" in the Department of the Treasury, supplementing Title 52 of the Revised Statutes and making an appropriation.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. There is established, in the Department of the Treasury, a nonlapsing revolving fund entitled the "Lead Toxicity Detection and Prevention Fund." The fund shall be maintained by the State Treasurer and may be held in depositories selected by the Treasurer, and may be invested and reinvested as other funds in the custody of the treasurer, in the manner provided by law. The fund shall be credited with monies appropriated or otherwise made available for the purposes of the fund, all returns on the investment thereof by the State Treasurer, and any principal and interest received in repayment of loans which may be made from the fund.

    b. Moneys in the fund shall be appropriated for the purposes of lead toxicity screening and follow-up by the State Department of Health pursuant to P.L. , c. (C. )(now before the Legislature as Assembly Bill No. 1038 of 1992), for the lead toxicity awareness and information program conducted by the Department of Human Services pursuant to P.L. , c. (C. )(now before the Legislature as Assembly Bill No. 1856 of 1992), for the pilot project on identification of lead sources by the Department of Environmental Protection pursuant to P.L. , c. (C. )(now before the Legislature as Assembly Bill No. of 1992), and for the development of a model lead abatement program by the Department of Community Affairs pursuant to P.L.   , c. (C. ) (now pending before the Legislature as Assembly Bill No. of 1992) and for start up funding for a certification program for lead inspectors and removal workers, pursuant to P.L. , c. (C. ) (now before the Legislature as Assembly Bill No. 1350 of 1992).

    c. Funds exceeding the amount necessary for the programs delineated herein, if any, may be appropriated to the Department of Health for the provision to appropriate local boards of health of technical advice or assistance in enforcing lead abatement measures pursuant to P.L.1971, c.366 (C.24:14A-1 et seq.).

 

    2. The State Treasurer may, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) adopt such rules or regulations as are necessary for the implementation of this act.

 

     3. There is appropriated, from the General Fund to the "Lead Toxicity Detection and Prevention Fund" the sum of $3,755,000.00.

 

    4. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill establishes a "Lead Toxicity Detection and Prevention Fund," in the Department of the Treasury, to fund lead testing programs, studies on lead sources and routes and lead abatement techniques, public awareness programs concerning lead toxicity, and the initial phases of a training and certification program for lead inspectors and lead abatement workers. Funds not needed for these purposes may be appropriated for State technical advice and assistance to county and municipal governments for lead abatement enforcement. The bill appropriates $3,755,000 from the General Fund to the "Lead Toxicity Detection and Prevention Fund."
