An Act concerning air quality standards in school buildings, supplementing P.L.1983, c.516 and making an appropriation.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. The Department of Labor shall adopt, pursuant to the Administrative Procedures Act, P.L.1968, c.410 (C.52:14B-1 et seq.), air quality standards for public school building to be enforced under the "New Jersey Public Employees' Occupational Safety and Health Act," P.L.1983, c.516 (C.34:6A-25).

    b. Notwithstanding any other law to the contrary, any air quality standards applicable to public school buildings adopted by the Department of Community Affairs pursuant to the "State Uniform Construction Code Act," P.L.1975, c.217 (C.52:27D-119 et seq.) shall not, to the extent of any inconsistency, supercede the air quality standards for public school buildings adopted by the Department of Labor pursuant to subsection a. of this section or the authority of the Department of Labor to enforce those standards.

 

    2. There is appropriated to the Department of Labor from the general fund the sum of $250,000 for the purpose of the enforcement of the air quality standards promulgated pursuant to section 1 of this act.

 

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill directs the Department of Labor to promulgate regulations setting forth air quality standards for public school buildings to be enforced under the "New Jersey Public Employees' Occupational Safety and Health Act." The regulations adopted by the Department of Labor will supercede any inconsistent regulations set forth in the Uniform Commercial Code.

    Finally, the bill appropriates $250,000 to the Department of Labor in order to enforce the air quality standards so adopted.
