An Act concerning municipal regulation of certain streets and supplementing chapter 67 of Title 40 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding the provisions of R.S.39:4-197 or any other law to the contrary, the governing body of any municipality may, by ordinance, without the approval of the Commissioner of Transportation, prohibit through traffic on a street within the municipality upon a finding by the governing body that through traffic on that street creates an undue risk to the safety and welfare of the residents of the municipality. Prior to making such a finding the municipality shall hold at least one public hearing and shall create a written record documenting the basis for the prohibition of through traffic. Upon adoption of the ordinance, the municipality shall erect appropriate signage where through traffic is prohibited and shall submit a copy of the written record to the Department of Transportation to be used by the department for informational purposes.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill would authorize a municipality to prohibit through traffic on a street within the municipality upon a finding by the governing body of the municipality that through traffic on that street creates an undue risk to the safety and welfare of the residents of the municipality. The bill would require that a public hearing be held prior to making such a finding and further requires that the municipality create a written record documenting the basis for the prohibition of through traffic. After adoption of the ordinance, the municipality would be required to erect appropriate signage where through traffic is prohibited and to submit a copy of the written record to the


Department of Transportation to be used by the department for informational purposes.
