An Act concerning the testing of certain persons for tuberculosis and supplementing Title 45 of the Revised Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. The New Jersey Board of Nursing shall require registered professional nurses, licensed practical nurses, and certified homemaker-home health aides to be tested annually for tuberculosis infection.

 

    2. In accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), the New Jersey Board of Nursing shall adopt rules and regulations necessary to implement the provisions of section 1 of P.L. , c. (C. )(pending before the Legislature as this bill).

 

    3. A home health aide who provides care to a senior citizen or disabled person in the person's home and is employed by a home health care agency, nurses' registry, employment agency, or temporary help agency which is licensed or regulated by the Division of Consumer Affairs in the Department of Law and Public Safety, shall be tested annually for tuberculosis infection.

 

    4. In accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), the Director of the Division of Consumer Affairs shall adopt rules and regulations necessary to implement the provisions of section 3 of P.L. , c. (C. ) (pending before the Legislature as this bill).

 

    5. This act shall take effect immediately.


STATEMENT

 

    This bill requires that the New Jersey Board of Nursing ensure that registered professional nurses, licensed practical nurses, and certified homemaker-home health aides are to be tested annually for tuberculosis infection. The bill also requires a home health aide or other health care employee who provides care to a senior citizen or disabled person in the person's home and is employed by a home health care agency, nurses' registry, employment agency, or temporary help agency which is licensed or regulated by the Division of Consumer Affairs in the Department of Law and Public Safety, to be tested annually for tuberculosis infection.
