ASSEMBLY LAW AND PUBLIC SAFETY COMMITTEE

STATEMENT TO

ASSEMBLY, No. 859

STATE OF NEW JERSEY

DATED: MARCH 3, 1997

The Assembly Law and Public Safety reports favorably and with committee amendments Assembly Bill No. 859.

Under Assembly Bill No. 859, the prosecuting agency must notify the chief of police, or the chief's designee, of the municipality in which a crime occurred whenever a defendant is released on bail or otherwise discharged. The provision is operative upon submission of a written request to the agency by the chief or designee.

As amended by the committee, the bill's provisions are only applicable when the defendant has been charged with a first or second degree crime.

This bill was pre-filed for introduction in the 1996 legislative session pending technical review. As reported, the bill includes the changes required by technical review which has been performed.
