An Act concerning eligibility for the "Pharmaceutical Assistance to the Aged and Disabled" program and supplementing P.L.1975, c.194.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. The increase in income eligibility limits provided in section 1 of P.L.1995, c.27 shall be retroactive to January 1, 1994.

 

    2. The Commissioner of Human Services shall promulgate rules and regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) which establish the procedure by which the department shall determine a person's eligibility for the retroactive benefits.

 

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill makes the current "Pharmaceutical Assistance to the Elderly and Disabled" program income eligibility limits of $16,624 for a single person and $20,383 for a married couple retroactive to January 1, 1994. P.L.1995, c.27 raised the income eligibility limits to their current levels, however, this law was only retroactive to January 1, 1995.
