An Act concerning the issuance of bonds by certain school districts and supplementing chapter 24 of Title 18A of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding any statute to the contrary, whenever a board of education of a type II school district determines to undertake the renovation, repair or other alteration of an existing school building in order the bring that building into compliance with State health, safety or fire code requirements, the board may submit the proposed facilties project to the Commissioner of Education for a determination as to whether the renovation, repair or alteration is necessary in order to meet State health, safety or fire code requirements. If the commissioner determines that the facility is not in compliance with State health, safety or fire code requirements and that the proposed facilities project is necessary for those purposes, the commissioner shall waive the holding of a referendum as required pursuant to chapter 24 of Title 18A of the New Jersey Statutes. Upon receiving the waiver, the board of education may issue bonds for the financing of the facilities project without first placing the question before the voters of the district.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill would permit the Commission of Education to waive the requirement that a type II school district submit a proposal to bond for a construction project to public referendum if the commissioner determines that the project is necessary in order to bring the school facility into compliance with State health, safety or fire code regulations.

 

Allows waiver of referendum for bonding for construction projects necessary for State health, safety or fire code requirements.
