An Act concerning the revocation of firearms purchaser identification cards and handgun purchase permits in certain cases, and supplementing chapter 58 of Title 2C of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. Whenever a person is convicted of a crime, the conviction of which subjects the person to the provisions of N.J.S.2C:39-7, the Superior Court shall so notify the superintendent and the chief law enforcement officer of the municipality wherein that person resides. If the superintendent or chief law enforcement officer determines that the convicted person was issued or possesses a firearms purchaser identification card or an unexpired handgun purchase permit under the provisions of chapter 58 of Title 2C of the New Jersey Statutes, notice shall be given to the holder that the identification card or unexpired permit is void and shall be immediately surrendered to the chief law enforcement officer of the municipality. Notice shall be in a manner and form prescribed by the superintendent. This notice requirement is not intended to eliminate the existing obligation on the person to comply with all applicable provisions of N.J.S.2C:58-3 or N.J.S.2C:58-4 concerning the surrender of firearms and firearms purchaser identification cards, permits to purchase handguns and permits to carry.

    b. Any person required to surrender a firearms purchaser identification card or an unexpired handgun purchase permit under the provisions of this section or subsection f. of N.J.S.2C:58-3 shall sell, give, transfer, assign or otherwise dispose of all the firearms in his possession within three days of surrendering that card or unexpired permit to a person who is qualified under the provisions of chapter 58 of Title 2C of the New Jersey Statutes to acquire, receive or possess a firearm.

 

    2. This act shall take effect immediately and shall apply to persons convicted of crimes on and after that date.

STATEMENT

 

    This bill establishes procedures for notification in certain circumstances when firearms purchaser identification cards and handgun purchase permits are no longer valid as a result of certain criminal convictions.

    Presently a person convicted of a crime is required to surrender his firearms purchaser identification card and any handgun purchase permit to the Superintendent of State Police within five days under the provisions of subsection f. of N.J.S.2C:58-3.

    This bill would require the court to notify the superintendent and chief law enforcement officer of the municipality whenever a person is convicted of certain crimes. The bill provides that this notification procedure shall be triggered when the conviction is for a crime which subjects the person to the provisions of N.J.S.2C:39-7. If the superintendent or chief law enforcement officer determines that the person convicted was issued a firearms purchaser identification card or handgun purchase permit, that person is to be notified that the card or permit is void and must be immediately surrendered to the chief law enforcement officer of the municipality. The bill also provides that this notice is not intended to eliminate the existing obligations on the person to comply with N.J.S.2C:58-3 or N.J.S.2C:58-4.

    The bill further provides that any person who is required to surrender a firearms purchaser identification card or a handgun purchase permit must transfer the ownership of any firearm he possesses within 3 days to another person who is qualified under New Jersey law to possess a firearm.

    The bill also provides that notification is not required for handgun purchase permits that have expired.
