An Act to amend and supplement "An Act making appropriations for the support of the State Government and the several public purposes for the fiscal year ending June 30, 1995 and regulating the disbursement thereof," approved June 30, 1994 (P.L. 1994, c.67).

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Section 1 of P.L.1994, c.67, the fiscal year 1995 annual appropriations act, is amended to read as follows:

 

 

DIRECT STATE SERVICES

54 DEPARTMENT OF HUMAN SERVICES

20 Physical and Mental Health

24 Special Health Services

7540 Division of Medical Assistance and Health Services

 

    The Commissioner of Human Services shall increase the minimum and maximum fees paid to a pharmacist who holds a retail permit for dispensing a prescription drug under the Medicaid and Pharmaceutical Assistance to the Aged and Disabled programs to a person other than a nursing home patient to $4.23 and $4.48, respectively. The Commissioner of Human Services shall identify savings from department appropriations for Direct State Services, Grants-in-Aid, State Aid or Capital Construction for transfer to the Division of Medical Assistance and Health Services sufficient to raise these fees as herein provided.

 

    2. This act shall take effect on the 60th day after enactment.


STATEMENT

 

    This bill adds language to the FY 1995 appropriations act to increase the minimum and maximum fees paid to pharmacists who hold retail permits for dispensing prescription drugs under the Medicaid and PAAD programs to a person other than a nursing home patient to $4.23 and $4.48, respectively. These dispensing fees have not been increased since July 1988. The increase provided in this bill will enable pharmacists to continue providing and dispensing prescriptions to Medicaid and PAAD recipients.
