An Act concerning school boards in certain State-operated school districts and supplementing P.L.1987, c.399 (C.18A:7A-34 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding any other law to the contrary, a school district which was classified as a Type I district prior to the creation of a State-operated school district shall continue to be classified as a Type I district upon reestablishment of local control. The school board shall consist of nine members as follows: three members shall be appointed by the mayor; three members shall be appointed by the Commissioner of Education; and three members shall be appointed by parent groups. For the initial school board, one member of each group shall be appointed for a term of one-year, one member of each group shall be appointed for a term of two years, and one member of each group shall be appointed for a term of three years. Thereafter, a member shall serve a term of three years.
2. This act shall take effect immediately.
STATEMENT
This bill provides that a school district which was classified as a Type I district prior to the creation of a State-operated school district would continue to be classified as a Type I district upon reestablishment of local control. The school board would consist of nine members as follows: three members to be appointed by the mayor; three members to be appointed by the Commissioner of Education; and three members to be appointed by parent groups. One member of each group would be appointed for a term of one-year, one member of each group would be appointed for a term of two years, and one member of each group would be appointed for a term of three years. Thereafter, a member would serve a term of three years.
Under the current statute, a special election is held during the year following the reestablishment of local control to determine the classification status of the district, either Type I or Type II, and the formation and membership of the school board are governed by the statutes relating to the classification status chosen.
