An Act concerning background checks of school district volunteers and supplementing chapter 6 of Title 18A of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. A board of education may adopt a policy which requires the fingerprinting and criminal history record check of any person who serves in a voluntary position in the school district. The board may pay all costs associated with the fingerprinting and criminal history record check. No criminal history record check shall be conducted, however, unless the person furnishes written consent to such a check.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill permits a board of education to adopt a policy which requires the fingerprinting and criminal history record check of any person who serves in a voluntary position in the school district. In addition, the board may pay all costs associated with the fingerprinting and criminal history record check. No criminal history record check would be conducted, however, unless the person furnishes written consent to such a check.

    Under the current statutes, a person who serves in a school district on a voluntary basis is exempt from a mandatory criminal history record check.
