ASSEMBLY JUDICIARY COMMITTEE

STATEMENT TO

ASSEMBLY, No. 1448

with committee amendments

STATE OF NEW JERSEY

DATED: MAY 1, 1996

The Assembly Judiciary Committee reports favorably and with committee amendments Assembly Bill No. 1448.

Currently the salary of the county prosecutor is $100,000.00. This bill would increase this salary to $115,000.00. The bill appropriates annually to the Department of Community Affairs for payment to each county for additional salary costs resulting from the increase in the salary of county prosecutors an amount equal to the amount by which the annual salary paid to the county prosecutor exceeds $100,000.00.

The bill in its original form also changed the statutes governing the salary ranges for first assistant prosecutors, county prosecutor’s principal assistants and all other assistant prosecutors. The committee amendments repeal these sections of law and substitute a new section 2 of the bill providing that these salaries shall be set by the board of freeholders in consultation with the county prosecutor.

The bill appropriates $157,500.00 to the Department of Community Affairs as a payment to each county for the increased costs associated with the salary of each county prosecutor for the first six months of this year until the beginning of the new fiscal year.

This bill will be retroactive to January 1, 1996.

As amended, the bill is identical to Senate Bill No. 490 (1R).
