An Act concerning salary overpayments to school board employees and supplementing chapter 29 of Title 18A of the New Jersey Statutes.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. Notwithstanding N.J.S.18A:6-10, N.J.S.18A:28-5, N.J.S.18A:28-6 or any other provision of law, a board of education may recover any salary monies paid in error to an employee through subsequent payroll deductions from the salary of the employee.

 

    2. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill permits a board of education to recover salary overpayments to an employee through payroll deductions. Currently, as held in Trenton Education Association v. Trenton Board of Education, 1986 S.L.D. 2415, a board may only attempt to freeze a tenured employees' annual salary notwithstanding annual increments until a salary overpayment is recouped.
