By Assemblyman CARROLL, Assemblywomen MYERS, Crecco, Assemblymen Gregg and Garrett

 

 

An Act concerning 1fines and1 penalty points 1[and fines]1 for 1[the offense of failure of motorist] failing1 to observe certain lane restrictions and supplementing chapter 1[5] 41 of Title 39 of the Revised Statues.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. a. 1 When the Commissioner of Transportation has by regulation designated restricted lane use for high occupancy vehicles, the driver of every vehicle shall obey those regulations, unless otherwise directed by a traffic or police officer.

    b. A person violating this section shall be subject to the following fine:

    (1) For the first offense, a fine of $50;

    (2) For the second offense, a fine of $100;

    (3) For the third offense, a fine of $200;

    (4) For the fourth offense, a fine of $400;

    (5) For the fifth and any subsequent offense, a fine of not less than $500.

    c. 1Penalty points, authorized pursuant to section 1 of P.L.1982, c.43 (C.39:5-30.5), shall not be assessed against a person who fails to observe high occupancy vehicle lane restrictions pursuant to regulations of the 1[Department] Commissioner1 of Transportation.

     1[b. A person who fails to observe high occupancy vehicle lane restrictions shall be subject to a fine not to exceed $50.]1

 

    2. This act shall take effect on the first day of the second month after enactment.
