An Act concerning the purchase of credit for temporary service and amending N.J.S.18A:66-14 and P.L.1954, c.84.

 

    Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

    1. N.J.S.18A:66-14 is amended to read as follows:

    18A:66-14. Any person employed temporarily as a teacher [whose temporary employment resulted, without interruption, in] who subsequently assumed permanent employment as a teacher, and any person who was employed as a substitute immediately prior to permanent employment may purchase credit for the temporary or substitute service. The purchase shall be made in the same manner and be subject to the same terms and conditions provided for the purchase of previous membership service by N.J.S.18A:66-9.

    2. Section 11 of P.L.1954, c.84 (C.43:15A-11) is amended to read as follows:

    11. Any person employed temporarily by an employer [whose temporary employment resulted, without interruption, in] who subsequently assumed permanent employment may purchase credit for that temporary service. The purchase shall be made in the same manner and be subject to the same terms and conditions provided for the purchase of previous membership service by section 8 of P.L.1954, c.84 (C.43:15A-8).

    3. This act shall take effect immediately.

 

 

STATEMENT

 

    This bill removes the requirement in the Teachers' Pension and Annuity Fund and the Public Employees' Retirement System that temporary service must result without interruption in permanent employment in order for credit to be purchased for the temporary service. The bill would instead allow members of the respective retirement systems to purchase previous temporary service even if that service did not "result in", nor immediately precede, the member's assumption of permanent employment.
