ASSEMBLY TRANSPORTATION AND COMMUNICATIONS COMMITTEE

STATEMENT TO

ASSEMBLY, No. 1606

STATE OF NEW JERSEY

DATED: SEPTEMBER 16, 1996

The Assembly Transportation and Communications Committee reports favorably Assembly Bill No.1606.

This bill would require that whenever the Division of Motor Vehicles (DMV) either proposes to issue, or issues, a revocation or suspension of a person's motor vehicle registration, driver's license or driving privileges that the notice of that action, or proposed action, be delivered by certified mail, restricted delivery.

Because notice is currently given by regular mail, there are instances where citizens, through no fault of their own, are unaware that their motor vehicle registrations or driver's licenses have been revoked or suspended by the DMV. Since a person is subject to enhanced penalties for operating a motor vehicle while on the revoked or suspended list, it is only fair that the DMV be required to adopt a more effective method of notifying individuals whose motor vehicle registrations, driver's licenses or driving privileges have been revoked or suspended, or who may be subject to such revocations or suspensions. This bill would required that all such notices be given by certified mail, restricted delivery.
